Appeal Court nullifies Senator David Mark’s election

The election that ushered in Senator David Mark in his fifth term has been nullified by a Court of Appeal sitting in Makurdi, Benue State.

The court has therefore ordered the re-run the election in the Senatorial district withing 90 days.

The All Progressives Congress candidate, Mr. Donald Onjah and David Mark had been dragging the case as the, as the former claimed that David Mark rigged his way in the last general election and therefore challenged the decision of Election Petition Tribunal for upholding the victory of the Peoples Democratic Party’s candidate.

Counsel to Mr. Onjeh, Adetunji Oso, appealed to the Appellate Court to annul the decision earlier made of the Tribunal, saying that the court was incorrect when it regarded the papers presented by his client as mere documentary hearsay.

According to Oso, the document had contain some fact about the rigging of the Senatorial district election because as the collation was ongoing in seven out of the total nine L.G.As, INEC went ahead to declare Senator David Mark as the winner.
